Terms and Conditions

*PLEASE READ BEFORE PLACING AN ORDER* 

The following is an agreement between You

("Your", "Client") and the owner ("I", "My", "Mine", "We", "Our", "Dessert at Tiffany's LLC")

Notice & Payments:

 

**All orders require a two weeks notice. Orders $300 and below require full payment at the time of booking; orders over $300 require a 50% NON- REFUNDABLE/NON- TRANSFERABLE retainer at the time of booking to reserve date. All payments are due at the time the invoice is sent. Payments are accepted via PayPal invoice. Although we may discuss your order’s details, if you do not pay your invoice we do not have your order confirmed in our calendar. No order is secured without payment. All invoices are canceled after 24 hours of non-payment; once an invoice is canceled it will not be resent and I will not be able to assist you with any future orders. Please do not request an invoice until you're ready to pay. Remaining balance is due one week prior to pick up; if not paid, order will be canceled and retainer forfeited.

 

 

Rush Fees:

 

 **In some cases last minute orders are accommodated if there is availability. A fee of $50 will be applied to all orders placed less than two weeks from the pick up date and $100 for next day orders. Same day orders are not accepted. All rush orders must be paid in full at the time of booking.

 

 

Refunds & Cancelations:

 

**All payments are NON-REFUNDABLE/NON-TRANSFERABLE, unless I agree to fault or I have to cancel your order due to unforeseen circumstances. If an order is canceled by the client one week prior to event date, date changes are acceptable and a credit equal to amount paid will be issued; credits are valid for 365 days from the cancelation date. All monies used to purchase items for the order prior to cancelation will be deducted from the credit. If you're unsure of a design or theme and give me creative control of your order and are not satisfied with the end results, it is understood that no refund will be given. Due to the nature of items sold; no returns are accepted under any circumstances.

 

 

Order Changes:

 

** Any changes made to an order must be reported within 72 hours after booking; this includes theme changes, add-ons, date changes, etc. Please note- additional charges may apply.

 

** PRICES AND TERMS ARE SUBJECT TO CHANGE WITHOUT NOTICE. Prices are non-negotiable. Sales and promos do not apply to any order already placed.

 

 

Treat & Cake Design:

 

** All photos provided to Dessert at Tiffany's LLC are for inspirational purposes only; I do not duplicate the work of others and cannot guarantee exactness even to my prior work.  Food grade colors may deepen over time resulting in a slightly darker color; although I do my best to match the colors provided I cannot guarantee an exact match. 

 

 

Cake Servings:

**Please choose cake size wisely as serving size estimations are based on how the cake is cut. Dessert at Tiffany's LLC is not responsible for a shortage of cake due to overcutting.

 

 

Pick-Up, Late Fees & Client Responsibility:

** All orders are pick up only. Availability is currently limited to weekends only; I do not accept orders for pick up during the weekday. Pick up is available on Saturdays from 9 AM-1 PM; any other day or time is at the owner's discretion. Pick up location is in Noblesville, IN 46062; address will be given once order is secured. There is a 10 minute grace period; orders picked up more than 10 minutes late will be subject to a $10 late fee that must be paid before order is released. Once an order is picked up by the client or a person elected by the client, Dessert at Tiffany’s LLC is NO LONGER RESPONSIBLE FOR ANY DAMAGES occurring during transport, set up, or any time thereafter. Please do not leave cakes and/or desserts in direct sunlight or in high temperature climates; store in refrigerator or a cool dry place. Please drive carefully and transport cakes and/or desserts in an air conditioned vehicle. No refund will be given for melted and/or damaged cakes and/or desserts due to improper handling and storage. The client is responsible for providing an appropriate environment for their cakes and/or desserts.

 

 

Unclaimed Orders:

**Any order that has not been picked up within 30 minutes of the designated pick up time without communication is considered an unclaimed order. In the event you fail to pick up your order, there will be no refund given! Further, Dessert at Tiffany's LLC reserves the right to resell the items or donate them to the charity of our choice. It is the responsibility of the client to pick up their order at the designated pick up location.

 

 

 Shipping:

 

**Full payment plus the shipping cost is due at the time of booking. All orders are shipped after processing time(1-5 days). Orders are shipped via USPS Priority Mail(1-3 day shipping). Please make sure your address is correct when paying invoice as this will be the address your order is shipped to. Dessert at Tiffany's LLC is NOT responsible for any returned packages, a fee will occur if package has to be mailed again. Once an item is shipped a tracking number will be provided via email. Dessert at Tiffany's LLC ensures orders are packed and secured properly before shipping to prevent damages. Dessert at Tiffany's LLC is NOT responsible for damages, delayed, lost, or stolen packages once USPS takes possession of the package and will NOT accept returns or refunds due to postal delays and/or damages, etc. All sales are final.

 

**Dessert at Tiffany's LLC is a ServSafe certified home-based bakery and products are produced in a home kitchen not subject to inspection by the State Department of Health; by placing an order you are agreeing that you are fully aware of this.**

 

 

Nut & Food Allergy Disclaimer:

**Dessert at Tiffany’s LLC is not an allergen-free, gluten- free business and its products and/or baked goods may contain or come into contact with the following ingredients: Nuts, Milk, Soy, Gluten, Eggs, Wheat, and other allergens not listed. We suggest that anyone with any kind of allergy refrain from consuming our products **The client is responsible for informing guests of any potential allergy hazards. Dessert at Tiffany's LLC is not responsible and will not be held liable for any allergic reactions or injuries sustained as a result of consumption.

 

 

 

***Payment serves as your signature and agreement to the terms and conditions in its entirety. In the event that you break the terms and conditions, you agree to pay all costs associated with filing a civil class suit on my behalf.*** 

 

**Dessert at Tiffany's LLC is not responsible if one fails to read terms and conditions in its entirety.**
